Mine opponents drop lawsuit

Opponents of the proposed Hap Taylor/Crown Pacific gravel mine four miles west of Sisters have dropped their lawsuit against the U.S. Forest Service.

However, a Notice of Intent to Appeal county approval of the surface mine was filed with the Oregon Land Use Board of Appeals on December 6.

In a letter dated December 8, lawyer James T. Massey wrote to the Office of General Counsel "...My clients intend to enter into direct discussion and
mediation with representatives of Hap Taylor & Sons and Crown in an effort to resolve the issues raised in this litigation and my clients' pending appeal to the Oregon Land Use Board of Appeals. They have decided, in order to avoid the cost of adversarial proceedings during the negotiation/mediation process, to dismiss the above action..."

Massey represented several Sisters families in the lawsuit.

According to mine opponent Jim Fisher, no specific negotiated proposals have been developed. The parties are only informally discussing mediation at this point and how that will be handled.
