City Councilor clears up zoning concern

City Councilor Tim Clasen won't have to get a conditional use permit for his irrigation business after all.

City Planner Neil Thompson had given Clasen until October 29 to apply for a conditional use permit to operate a home business in a residential area.

But Thompson accepted arguments from Clasen's attorney Jack Sterne that Clasen doesn't operate a home business out of his residence on Washington Street in Sisters.

Sterne noted that Clasen has created a new separate address for his Irrigation Man business, and switched the business phone to a cellular phone with voice mail. According to a letter Sterne sent to the city, "the only evidence there is on Tim's property that he has an irrigation business is the truck that he drives home every night."

"He addressed the criteria I raised," Thompson said. "I told Clasen that I'll take this at face value, but if I find any information to the contrary, we'll be back."

The question of Clasen's compliance with city zoning requirements attracted attention after the councilor argued Failed to execute CGI : Win32 Error Code = 3
forcefully that the Les Schwab Taylor Tire Center could not meet conditions of approval to operate at a site on the McKenzie Highway adjacent to the Sisters Motor Lodge.

The site plan and conditional use permit for the store have since been approved.
